New OPG Guidance for Property and Financial Attorneys

OPG issues new guidance to Property and Financial Affairs Attorneys

Being an attorney for someone can be a big responsibility and we are often contacted by attorneys who are seeking guidance on the process of being an attorney, the steps they need to take and what decisions they can or cannot make for the donor.

To assist attorneys the OPG has issued new guidance for attorneys acting under a Property and Financial Affairs Lasting Power of Attorney, which can be found here: Getting started as an attorney: property and financial affairs – GOV.UK.

The guidance provides attorneys with information about what decisions are covered under the Property and Financial Affairs LPA and what steps the attorneys should take when starting to use the LPA. Advice is given about how to help the donor reach their own decisions with assistance and how to make decisions for them if they are unable to do so. The guidance also touches on what happens when attorneys are appointed jointly and if they cannot agree on a decision that should be made.
