New divorce laws come into force on the 6th April. The Divorce, Dissolution and Separation Act 2020 will reform the law on divorce, dissolution, and separation. It will be replaced with a simple statement of irretrievable breakdown of the marriage.

New divorce laws come into force on the 6th April. The Divorce, Dissolution and Separation Act 2020 will reform the law on divorce, dissolution, and separation.  Divorce will no longer be based on fault, there is now no behaviour or adultery for example.  It will be replaced with a simple statement of irretrievable breakdown of the marriage.  There is to be no ability to defend a divorce and couples can for the first time make a joint application for a divorce.

There will a new minimum overall timeframe of 6 months made up of a “minimum period” of 20 weeks between the start of proceedings (when the court issues the application) and when the applicant may apply for a conditional order and the current minimum timeframe of 6 weeks between the conditional order and when the order can be made final.  This ensures that there is a period of reflection and where divorce is inevitable, provides a greater opportunity for couples to agree practical arrangements for the future.

This is the biggest reform of divorce laws for half a century and aims to reduce the impact that conflict and allegations of blame can have on families and in particular on any children.
